SUBJECT: L743 Contract Provision Regarding Layoffs and Vacancies
DATE: October 25, 2005

Effective Tuesday, November 1, 2005, a new procedure will be implemented regarding laid-off staff employees of Local 743 which will affect the posting of some unit vacancies. The new procedure will represent a departure from current job posting and hiring processes for vacant clerical and service maintenance positions.

In accordance with Section 6.4 of the recently negotiated Local 743 contract, in making hiring decisions for vacant clerical and service maintenance positions, preference should be given to laid-off employees of Local 743 regarding jobs for which they are qualified to perform in the same salary grade in the same occupational group (as listed in Appendices G and I), with preference to any such vacancies within the same department.

This means that vacant clerical and service maintenance positions will not be posted and that other job seekers may not apply for such a position until the pool of qualified, laid-off Local 743 employees has been interviewed and considered.

After receiving notice of vacant clerical or service maintenance positions, UHRM – Employee/Labor Relations will contact units with a list of Local 743 laid-off employees who are qualified to perform the work of a vacant position. Hiring managers are asked to give diligent consideration to hiring laid-off employees of Local 743 by agreeing to interview such candidates.

Units must either:

  • offer a vacant position to a laid-off Local 743 employee; or
  • provide job-specific reasons for declining to offer a position to a laid-off Local 743 employee.

Once this applicant pool has been exhausted, a unit’s vacant position will be posted.

This new procedure will reduce non-adherence to the contract and ensure preference is given to laid-off employees, per our contractual obligation.
